Melissa for Educators AI Platform

These Terms and Conditions (“Terms”) govern your access to and use of the Melissa platform (melissaforeducators.ai), including all related services, features, and content (collectively, the “Service” or “Melissa”). The Service is operated by Melissa for Educators (“we,” “us,” or “our”). By creating an account, signing up, or using the Service, you agree to these Terms. If you are entering these Terms on behalf of a school, district, or other entity, you represent that you have authority to bind that entity.

1. Eligibility and Accounts

  • You must be at least 18 years old and a teacher, administrator, or authorized representative of a K-12 school or district.
  • Teacher/administrator accounts use email + password (Supabase Auth). You are responsible for maintaining account security and all activity under your account.
  • Student accounts are created and managed under your classes:
    • Grades 6–12: You provide names only; students self-register via class code (no email required).
    • Grades K–5: You create accounts with picture passwords.
  • You warrant that you have all necessary rights, consents, and authorizations (including under COPPA and FERPA) to provide student data and allow students to use the Service for educational purposes.

2. Use of the Service

  • The Service is provided solely for K-12 educational purposes (lesson planning, assignment creation, student interaction, grading, and TIA-style documentation).
  • “Prepare a Class” and assignment features trigger an automated cascade (generation → delivery to students → completion → grading → documentation). You are responsible for reviewing all AI-generated content before use.
  • AI Zones (Prohibited / Assisted / Required) must be respected. Students may not circumvent them.
  • You grant us a limited license to host, process, and display content you or your students upload or generate.
  • We do not use student personal information to train AI models or for any purpose other than providing the Service.

3. Student Data and Compliance

  • You (or your school/district) own all student data. We act solely as a service provider and “school official” with legitimate educational interest under FERPA and under the school-consent exception to COPPA.
  • You are solely responsible for:
    • Obtaining any required parental consents or providing school-authorized notice.
    • Ensuring student data is used only for educational purposes.
    • Complying with all applicable laws (FERPA, COPPA, state student privacy laws, etc.).
  • We will not sell, rent, or use student data for marketing or advertising.

4. Payments and Subscriptions

  • Individual plans: Free trial then $99/year. District plans: custom pricing.
  • Payments processed via Stripe. Subscriptions auto-renew unless canceled.
  • We may change prices with notice. Refunds are at our discretion except where required by law.

5. Intellectual Property

  • The Service, AI models, prompts, and all original content are our exclusive property.
  • You retain ownership of your lesson plans, assignments, and student work. We may use anonymized, aggregated data to improve the Service (never student-identifiable data).

6. Prohibited Conduct

You may not: reverse-engineer the Service, circumvent AI zones, share login credentials, upload harmful code, or use the Service for any non-educational or illegal purpose.

7. AI Output Disclaimer

AI-generated content is probabilistic and may contain errors. You must review all output for accuracy, appropriateness, and alignment with standards before use with students. We are not liable for any reliance on or consequences of AI output.

8. Termination

We may suspend or terminate access for violation of these Terms, non-payment, or to protect the Service. Upon termination, student data remains available to you for export for 30 days (then securely deleted unless legally required to retain).

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or student outcomes. Our total liability will not exceed the amount you paid in the 12 months before the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from (a) your or your students' use of the Service, (b) any student data you provide, or (c) your failure to obtain required consents.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Disputes will be resolved in the courts of Travis County, Texas.

12. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance.
